The Constitution explicitly contemplates “Enlargement of the jurisdiction of the Supreme Court,” and empowers Parliament to make laws regulating the Supreme Court and its jurisdiction. Textual summaries of the constitutional provisions note Parliament’s power to legislate on the Court’s constitution, organisation and jurisdiction—i.e., Parliament can, by law, enlarge the Court’s jurisdiction with respect to matters in the Union List [2]. Neither the President, the Chief Justice nor the Law Ministry has unilateral constitutional authority to expand the Supreme Court’s jurisdiction; such a change requires Parliamentary legislation as provided by the Constitution [2].
